Welcome to AMB Fab. These Terms of Service ("Terms") govern your access to and use of the AMB Fab website, online store, products, services, content, and related resources.

Throughout these Terms, the words "AMB Fab," "we," "us," and "our" refer to AMB Fab.

AMB Fab operates this website and online store using Shopify, which provides the platform that allows us to offer our products and services.

By accessing, browsing, using this website, or purchasing any product from AMB Fab, you agree to these Terms of Service and any policies referenced in them. If you do not agree to these Terms, please do not use this website or purchase our products.

1. PRODUCTS AND PRODUCT INFORMATION

AMB Fab sells mini bike parts, brake components, frames, rollers, fabrication components, accessories, apparel, custom products, and other products and components.

Some products offered by AMB Fab are custom-fabricated, modified, conceptual, prototype, experimental, or intended for custom-build and fabrication applications.

Certain products may require additional:

  • Welding

  • Fabrication

  • Drilling

  • Cutting

  • Grinding

  • Machining

  • Modification

  • Assembly

  • Adjustment

  • Testing

before they can be installed or used.

We make reasonable efforts to provide accurate product descriptions, measurements, photographs, specifications, and other product information. However, product information may change and may not cover every possible application or installation condition.

The customer is solely responsible for determining whether a product is appropriate and compatible with the customer's intended application, vehicle, mini bike, equipment, or project.

AMB Fab does not guarantee that any product will be suitable for every application or intended use.

2. CONCEPT, CUSTOM, AND FABRICATED PRODUCTS

Some AMB Fab products are based on concepts, prototypes, custom designs, fabrication projects, or products intended to be incorporated into a larger customer-built project.

These products may require additional engineering, fabrication, modification, testing, or adjustment by the customer.

Purchasing or viewing a product does not constitute a representation by AMB Fab that the product is suitable for a particular application.

The customer is responsible for evaluating, testing, installing, modifying, and determining the suitability and safe use of the product for their particular application.

A product shown installed on an AMB Fab build, customer build, photograph, video, social-media post, or other example does not mean that the same product is suitable for every vehicle, mini bike, build, rider, or application.

3. CUSTOMER RESPONSIBILITY

By purchasing an AMB Fab product, you acknowledge that you are responsible for:

  • Determining whether the product is appropriate for your intended application.

  • Confirming compatibility with your vehicle, mini bike, equipment, or build.

  • Proper installation and assembly.

  • Proper welding and fabrication where required.

  • Selecting appropriate hardware and supporting components.

  • Proper adjustment and setup.

  • Inspecting the product before installation.

  • Inspecting the product after installation.

  • Regularly inspecting the product during use.

  • Determining whether the completed assembly is safe.

  • Following applicable laws, regulations, and safety requirements.

  • Using appropriate protective and safety equipment.

AMB Fab does not determine whether your completed vehicle, mini bike, equipment, or project is safe for operation.

4. WELDING AND FABRICATION

Certain AMB Fab products require welding or additional fabrication.

Products requiring welding or fabrication are not necessarily direct bolt-on products.

When welding, cutting, drilling, grinding, machining, or other fabrication is required, the customer is responsible for ensuring that the work is performed correctly.

AMB Fab strongly recommends that welding and fabrication work be performed by a qualified and experienced professional.

AMB Fab is not responsible for damage, injury, product failure, vehicle damage, or other loss resulting from improper welding, fabrication, modification, assembly, or installation.

5. SAFETY AND USE OF PRODUCTS

Many AMB Fab products are intended for custom, recreational, off-road, powersports, mini bike, fabrication, or modified-vehicle applications.

Such activities may involve inherent risks, including but not limited to:

  • Falls

  • Collisions

  • Loss of control

  • Mechanical failure

  • Brake failure

  • Steering failure

  • Structural failure

  • Fire

  • Property damage

  • Serious bodily injury

  • Death

You voluntarily assume responsibility for the risks associated with the installation and use of AMB Fab products to the fullest extent permitted by applicable law.

You are responsible for determining whether your vehicle, equipment, or completed project is suitable and safe for operation.

AMB Fab does not assume responsibility for how a customer chooses to install, modify, operate, or use a product.

6. INSTALLATION, MODIFICATION, AND MISUSE

AMB Fab products may be modified, installed, or incorporated into projects in ways that are outside AMB Fab's control.

AMB Fab is not responsible for products that have been:

  • Improperly installed

  • Improperly welded

  • Modified

  • Altered

  • Cut

  • Drilled

  • Machined

  • Ground

  • Reworked

  • Improperly assembled

  • Used with incompatible components

  • Used outside their intended application

  • Used contrary to product instructions or warnings

Any modification to an AMB Fab product after purchase is performed at the customer's own risk.

7. CUSTOMER INSPECTION

Customers are responsible for inspecting products upon receipt and before installation or use.

Do not install or use a product if you believe it is damaged, defective, incompatible, incorrectly sized, or otherwise unsuitable for your application.

If you have concerns about a product, contact AMB Fab before installing, modifying, or using the product.

8. NO PROFESSIONAL ENGINEERING OR SAFETY CERTIFICATION

Unless specifically stated in writing, AMB Fab does not provide professional engineering, structural certification, vehicle certification, safety certification, or professional inspection services through the sale of its products.

Product dimensions, measurements, drawings, photographs, examples, and recommendations are provided for informational purposes.

Customers are responsible for obtaining professional engineering, fabrication, inspection, or other professional services when necessary for their particular application.

9. PRODUCTS SOLD "AS IS"

To the fullest extent permitted by applicable law, products are provided "AS IS" and "AS AVAILABLE," except where AMB Fab expressly provides a written warranty for a particular product.

AMB Fab disclaims warranties to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose, except where such disclaimers are prohibited by applicable law.

Nothing in these Terms is intended to remove or limit any legal rights or remedies that cannot lawfully be excluded.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMB FAB, ITS OWNERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INJURY, DEATH, PROPERTY DAMAGE, VEHICLE DAMAGE, EQUIPMENT DAMAGE, LOSS, CLAIM, EXPENSE, OR OTHER DAMAGE ARISING FROM OR RELATED TO THE INSTALLATION, MODIFICATION, ASSEMBLY, MISUSE, IMPROPER USE, OR OPERATION OF AN AMB FAB PRODUCT.

This includes claims arising from or related to:

  1. Improper installation;

  2. Improper welding or fabrication;

  3. Modification or alteration of a product;

  4. Improper assembly;

  5. Use of incompatible components;

  6. Failure to inspect or maintain a product;

  7. Use outside the intended application;

  8. Racing or competition use;

  9. Off-road use;

  10. Recreational use;

  11. Excessive or improper operation;

  12. Abuse or misuse;

  13. Negligent operation;

  14. Failure of another component;

  15. Customer-designed or customer-performed modifications; or

  16. Any other use of a product outside AMB Fab's direct control.

To the fullest extent permitted by applicable law, AMB Fab shall also not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of use, replacement costs, or similar damages.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

11. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless AMB Fab and its owners, employees, contractors, agents, affiliates, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your breach of these Terms;

  • Your installation, modification, fabrication, assembly, or use of an AMB Fab product;

  • Your misuse of an AMB Fab product;

  • Your violation of applicable laws or regulations;

  • Your negligence or intentional misconduct; or

  • Your vehicle, equipment, or completed build.

12. ORDERS

When you place an order through our website, you are submitting an offer to purchase the products in your order.

AMB Fab reserves the right to accept, decline, cancel, or limit an order, subject to applicable law.

We may contact you using the information provided with your order if we need additional information or if an issue arises with your order.

You are responsible for reviewing your order carefully before completing your purchase.

13. RETURNS AND REFUNDS

All returns are subject to the AMB Fab Return Policy.

Customers must contact AMB Fab before returning any product.

Returns sent without prior contact or approval may be refused.

Please review the AMB Fab Return Policy for information regarding:

  • The 30-day return-request period;

  • Return eligibility;

  • Required product condition;

  • Proof of purchase;

  • Restocking fees;

  • Return instructions; and

  • Refund processing.

The AMB Fab Return Policy is incorporated into these Terms of Service.

14. CUSTOM, MADE-TO-ORDER, AND PRODUCTION ITEMS

Certain AMB Fab products may be made to order, custom fabricated, cut to order, printed to order, or otherwise produced after an order is placed.

Production times stated on product pages are estimates and may vary depending on workload, materials, supplier availability, and other circumstances.

Customers should review production-time information before placing an order.

Unless otherwise stated in the applicable product listing or Return Policy, custom, personalized, modified, made-to-order, or production items may be subject to different return or cancellation restrictions.

15. SHIPPING AND DELIVERY

Shipping and delivery times are estimates and are not guaranteed.

AMB Fab is not responsible for delays caused by shipping carriers, weather, customs, natural disasters, supply issues, manufacturing delays, or other circumstances outside our reasonable control.

Customers are responsible for providing accurate shipping information.

Once an order has been transferred to the shipping carrier, carrier delays are outside AMB Fab's control.

16. THIRD-PARTY PRODUCTS, SERVICES, AND LINKS

The AMB Fab website may contain links to third-party websites, products, manufacturers, suppliers, tools, services, and resources, including links contained in our Build Resources.

AMB Fab does not control or guarantee the quality, accuracy, availability, safety, or performance of third-party products or services.

Any transaction made with a third party is between you and that third party.

AMB Fab is not responsible for injury, damage, loss, or other claims arising from third-party products, services, websites, or resources.

17. INTELLECTUAL PROPERTY

All content appearing on the AMB Fab website, including logos, trademarks, product names, photographs, graphics, designs, text, videos, and other original content, is owned by or licensed to AMB Fab unless otherwise stated.

You may not reproduce, copy, modify, distribute, sell, publish, or commercially use AMB Fab content without prior written permission.

18. ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, availability, shipping charges, production times, or other information.

AMB Fab reserves the right to correct errors, update information, modify product information, or cancel an order affected by an error, subject to applicable law.

21. SHOPIFY

AMB Fab's online store is powered by Shopify.

However, purchases made through our store are transactions between you and AMB Fab.

Shopify is not responsible for the products sold by AMB Fab or for the installation, modification, or use of AMB Fab products.

22. PRIVACY

Personal information collected through the website is handled in accordance with our Privacy Policy.

By using the website, you acknowledge that you have reviewed our Privacy Policy.

23. FEEDBACK

If you voluntarily submit reviews, suggestions, ideas, photographs, videos, or other feedback to AMB Fab, you grant AMB Fab permission to use that content for business, marketing, promotional, or operational purposes, subject to applicable law.

These Terms supersede prior agreements or communications concerning the same subject matter.

These Terms shall be governed by the applicable laws of the State of California, without regard to conflict-of-law principles, except to the extent that applicable law requires otherwise.

Any provision of these Terms that cannot legally be enforced in a particular jurisdiction shall not affect the enforceability of the remaining provisions.

AMB Fab may update these Terms of Service from time to time.

The most current version will be posted on this page with the applicable effective date.

Your continued use of the website after changes are posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.
